The fine print
(a.k.a. our terms and conditions)

Intro

Welcome to MG Digital! We’re excited to work with you. These terms outline what you can expect from us, what we expect from you, and how we handle things if challenges come up or expectations change.

When you engage our services, you agree to these terms—so grab a coffee and give them a quick read.

What we do

We provide:

  • Marketing consultations – Strategic advice tailored to your business goals.
  • Fractional marketing services – Ongoing support in areas like social media, content creation, digital marketing, marketing automation, and strategy development.
  • Free marketing consultations – A one-time offer exclusively for startups.

We reserve the right to decline a consultation if there’s a conflict of interest or if the eligibility criteria aren’t met.

We might tweak or pause a service now and then. But don’t worry — we’ll always give you a heads-up when it matters.

Free consultation policy

→ Who qualifies?

  • Each startup gets one free consultation.
  • If you’ve closed a business and started a new one, you’ll need to wait six months before booking another free session.

→ Preparing for your session

  • We’ll send you a short survey. Fill it out at least 5 business days before the consultation.
  • If we don’t get your responses in time, we may need to reschedule your session.

→ Need to reschedule?

  • No problem! You can reschedule once as long as you give us at least 24 hours' notice on a business day (Monday to Friday).

Paid consultation policy

→ Booking and payment

  • Once you book, we’ll send an invoice.
  • Payment must be made at least 48 hours before the session.

→ Payment delays

If payments run late, we may need to apply a small interest — as allowed by law — to keep things fair on our side too.

We’d much rather avoid this, so let’s keep communication open if something comes up.

→ Cancellation and refunds

  • Cancel 4+ business days before – full refund.
  • Cancel between 4 and 2 business days before – 50% refund.
  • Cancel less than 2 business days before – no refund.

→ What if I don’t show up?

If you don’t attend and don’t let us know in advance, you won’t be eligible for a refund.

→ Not satisfied? We’ve got a money-back policy (because we stand by our work)

  • Let us know within 7 days of the consultation.
  • Tell us why you weren’t satisfied, and we’ll assess your request

Fractional marketing services

→ Payments

  • We bill in the second half of the previous month, and payment is due within 7 days.
  • If payment isn’t received by the first day of the service month, we may pause your services until it’s sorted.

→ What if I need to cancel?

  • You can end your agreement with a 30-day written notice.
  • Exception for first-time clients: In your first month, you can cancel at any time—no 30-day notice required. However, the full first-month payment is still due, even if you cancel early.
  • Payments for any services already provided are non-refundable.

→ Payment delays

If payment isn’t made on time, we may need to apply a small interest — as allowed by law — to keep things fair on our side too.

We’d rather not go there, so if something comes up, just talk to us.

Confidentiality and intellectual property

→ Your business stays your business.

We respect confidentiality and won’t share your proprietary info with anyone.

→ Who owns the work we create?

Unless we’ve agreed otherwise in writing, we keep ownership of everything we create for you — strategies, content, ideas, all that good stuff.

You get a license to use it in your business, but you can’t sell it, republish it, or pass it off as your own without our OK.

Limits of liability and warranties

→ We’re here to help, but…

  • We can’t be held responsible for indirect, incidental, or unexpected damages (like lost profits or business disruptions).
  • If something goes wrong, our liability is capped at the amount you paid us for the service.

→ Our best efforts, your realistic expectations

We’re committed to doing our best work on every project. While we can’t guarantee specific results—especially when external factors are beyond our control—we always act in your best interest and aim for outcomes that move your business forward.

If things go wrong (dispute resolution)

→ Let’s talk first.

If there’s a problem, we’ll try to resolve it through mediation before taking legal action. We’re committed to resolving disputes amicably and professionally.

→ If payment is overdue…

  • If payment isn’t received after three reminders, we may take legal action.
  • In Spain, this means using the order for payment procedure (“proceso monitorio”) to recover outstanding invoices.

Updates to these terms

We may update these terms from time to time. If we make significant changes, we’ll post them on our website and may notify you via email.

Governing law

These terms fall under the laws of Spain.

Unexpected disruptions (force majeure clause)

We’re not responsible if we can’t deliver services due to events beyond our control, such as:

  • Power outages
  • Internet disruptions
  • Government restrictions
  • Natural disasters
  • Other unpredictable events

How we handle your data

We process personal data in line with data protection laws. For full details, check out our Privacy and cookies policy here

If something you provide causes a problem (indemnification clause)

You agree to hold us harmless if any legal issues arise from the content, materials, or instructions you provide.

Example: If you send us an image to use in your marketing, but it turns out you don’t have the rights to it, and we get into legal trouble, you’re responsible for the consequences—not us.

This bit still applies even after we’ve high-fived and gone our separate ways.

This is the whole deal

This document is the full agreement between you and MG Digital.

  • It replaces any previous chats, emails, or informal promises.
  • If it’s not written here (or agreed in writing), it’s not part of the deal.
